Caleb Flynn’s Digital Trail Met Shavaun Scott’s Psychology 05.10.2026 44minThe Caleb Flynn case ended with guilty verdicts on all nine charges, but the path there was built one piece at a time. Prosecutors gave jurors 107,000 messages between Flynn and Alleigha Botner, forensic data from his devices, surveillance evidence, and a timeline they said contradicted his account of an intruder. The defense told jurors that the State had no murder weapon and that Flynn's affair made him easy to dislike without proving he killed Ashley. After forty prosecution witnesses, the defense rested without calling a witness. Jurors deliberated for just over two hours before convicting Flynn, including on aggravated murder. Then the episode shifts from evidence to behavior. Psychotherapist Shavaun Scott joins Tony Brueski to examine why Flynn and Botner kept returning to the same relationship cycle despite missed deadlines and broken promises. Scott explains intermittent reinforcement, sunk-cost thinking, compartmentalization, and the belief that two incompatible lives can somehow continue without consequences. The distinction matters. Scott is analyzing a relationship pattern after the fact. The jury convicted on the evidence presented in court, including testimony, messages, surveillance, and digital records. The combined episode asks viewers to hold both tracks at once. What did prosecutors prove to the jury, and what can the relationship history tell us about the emotional machinery operating around those facts?Flynn is scheduled to be sentenced October 5 and faces the possibility of life without parole. The verdict is in. The arguments over what drove the behavior are only beginning.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Delphi Appeal: The Suspect, Sketch and Bullet the Jury Missed 04.10.2026 33minRichard Allen’s appeal put three things in front of the Indiana Court of Appeals that his jury did not get in the same way: the Brad Holder alternate-suspect theory, Betsy Blair’s sketch, and William Tobin’s proposed challenge to the cartridge evidence. Defense attorney Bob Motta joins Tony Brueski to work through why each exclusion matters legally — and why the State says none of them requires a new trial. On Holder, appellate lawyer Mark Leeman argued police received tips about him in 2017 and later learned of a rune-like marking on his hand and social-media posts the defense believed had similarities to the scene where Abby Williams and Libby German were found. Holder has never been charged. Trial Judge Frances Gull excluded the defense theory under Indiana’s direct-connection rule. At oral argument, the State emphasized Holder’s landfill work records and argued the defense could not connect him to the murders. On the physical evidence, the State relied on testimony that an unfired .40-caliber cartridge recovered near the girls had been cycled through Allen’s Sig Sauer. The defense says the jury should also have heard from former FBI metallurgist William Tobin about limits in that type of comparison. Gull excluded Tobin, concluding he was not a firearms examiner and had not examined the evidence himself. Then there is Betsy Blair, who saw a man near the bridge shortly before the girls arrived and helped develop a sketch that was not shown to the jury. The State says Blair identified the man in Libby German’s Bridge Guy image as the person she saw and points to Allen’s own statement placing him on the trail. Bob Motta breaks down the direct-connection rule, expert-evidence standards and harmless-error analysis while the appeal remains under advisement.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Murdaugh Retrial Moves as Missing-Weapons Probe Grows 04.10.2026 29minAlex Murdaugh’s retrial is leaving Colleton County and the entire Fourteenth Judicial Circuit. Judge Debra McCaslin selected Sumter County after finding that the original jury-selection numbers, deep local ties to the Murdaugh family, the Becky Hill scandal, and relentless publicity made another local trial too risky. The defense had argued for Charleston and offered to permanently waive venue appeals if it got that venue. It did not. McCaslin chose Sumter, and jury selection is set to begin April 5, 2027.That would be enough for one major retrial story. Then came the missing-weapons reporting. Investigators are reportedly examining allegations that Yemassee Police Chief Greg Alexander and another officer handled weapons and bloody clothing after Maggie and Paul Murdaugh were killed at Moselle. The shotgun and rifle used in the killings have never been recovered. Alexander has not been charged, and his attorney has publicly rejected the allegations.Alexander’s connection to the Murdaugh family is already part of the public record. Alex Murdaugh wrote him a $5,000 check a little more than a month after the murders. Alexander previously described that payment as money passing through him for a family loan and declined to say whether it was repaid. He was also at Moselle the night of the killings despite Yemassee having no jurisdiction over the property.Tony Brueski breaks down why the venue decision and the weapons inquiry belong in the same conversation without being treated as the same kind of evidence. One is a judge’s ruling about where the retrial can be fair. The other is a reported investigation into allegations that could become significant only if prosecutors or the defense can actually prove them.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? JP Miller Got a SIXTH Delay — So What Happens Now?! 04.10.2026 28minJP Miller's federal cyberstalking case has been pushed back again. His defense has now obtained a sixth continuance, moving the trial into January 2027. The government has agreed to the delays, Miller has waived his speedy-trial rights, and the case keeps moving farther from the December 2025 indictment that started it.The charges themselves have not changed. Federal prosecutors accuse Miller of cyberstalking Mica Miller and making false statements to investigators. The indictment alleges unwanted and harassing communications, tracking devices, interference with her finances and daily activities, damage to her vehicle, and a tire-deflation device. Miller has pleaded not guilty and has not been charged in connection with Mica's death. But another part of Miller's public history keeps resurfacing. In October 2023, he told his Solid Rock congregation that he was going through deliverance and that demons were coming out of him. There is no court filing showing that he intends to blame demons for the federal charges. Still, the language stands in sharp contrast to an email described in a sworn affidavit by Mica's brother Nate Francis, in which JP allegedly wrote that when someone hurt him, he tried to hurt them back and would attack to cause pain. That makes the legal question much less supernatural. What evidence does the government have? What will be admissible? What can the defense challenge? And after six continuances, what does another delay actually accomplish for either side?Tony Brueski follows the case into its next phase, where pulpit explanations stop mattering and federal rules take over. Whatever JP Miller once said about demons, the January 2027 case will rise or fall on documents, digital evidence, witness testimony, and the government's burden of proof.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Caleb Flynn's Affair Started With WHAT Power Imbalance?! 04.10.2026 37minThe jury heard more than 100,000 messages between Caleb Flynn and Alleigha Botner, but the most important question may not begin with the worst sentence either of them wrote. It may begin with how the relationship started. Botner testified that she met Flynn while she was a young intern at their church. He was older, married, and part of the worship team. Years later, she was reading messages in court about Ashley Flynn’s death.Jennifer Coffindaffer and Robin Dreeke analyze the trial evidence from the law-enforcement and behavioral side. Botner acknowledged the July 2025 message in which she wrote that she wanted Ashley dead, followed by Flynn’s response: “that makes two of us.” She said she did not mean it. The panel also examines the September exchange over Ashley’s phone, when Flynn proposed getting the device while Ashley slept and Botner responded with caution, practical questions, and finally “Perfect.”Psychotherapist Shavaun Scott takes the relationship back to its beginning. She discusses the age and authority gap, the trust attached to a church setting, and the “roommate” story Flynn allegedly used to describe his marriage. Scott also looks at the secrecy, matching Harry Potter tattoos, and AI-generated love songs as ways a private relationship can become its own closed reality, separate from the people most likely to challenge it.That analysis now sits beside a verdict. On September 29, 2026, a jury convicted Flynn of aggravated murder and eight other charges in Ashley’s killing. The defense maintained that an intruder was responsible and argued the prosecution had turned an affair and terrible messages into a substitute for direct proof. Flynn is scheduled to be sentenced October 5. Coffindaffer and Scott explain what the messages show, what they do not show by themselves, and how the relationship surrounding them became part of the case.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Caleb Flynn Said WHAT Before Police Tested His Story?! 04.10.2026 47minA jury heard Caleb Flynn’s private messages about Ashley. Then it watched Detective Mike Morgan test Caleb’s story about the night she died. Put together, those two parts of the trial show why the prosecution kept returning to the same question: were these words just talk, or did they line up with what investigators found inside the house?Alleigha Botner testified about a June 12, 2025 exchange that ended with Caleb writing, “I’ve never joked about it.” The jury also heard later messages including “please take her out” and a statement that he had been awake until 4 a.m. thinking of ways to kill Ashley and avoid jail. The defense argued that the messages were offensive and deceptive but did not prove Caleb was the shooter. In Caleb’s second interview on February 16, 2026, Morgan shifted from listening to confronting. He raised the garage-door damage, questioned whether the supposed entry point made sense, and described the shooting position in the bedroom. Then he used Caleb’s own account of standing at the edge of the bed to put him in that same location. Caleb agreed with the description.Tony Brueski is joined by retired FBI behavioral expert Robin Dreeke and 25-year FBI veteran Jennifer Coffindaffer to break down the detective’s strategy, the significance and limits of Caleb’s responses, and how the Botner messages fit into the larger evidentiary picture.Caleb Flynn was convicted September 29, 2026, on all nine charged counts. The defense has indicated it plans to appeal.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Richard Allen's Prison Conditions Triggered WHAT From the Judge?! 03.10.2026 53minThis special Delphi episode is a combo of the “Before the Appeal” commentary followed by discussion of the appeal hearing with defense attorney Bob Motta. It moves from the arguments Richard Allen’s team planned to make into the moments that actually mattered once three Indiana Court of Appeals judges began questioning both sides.Allen’s appeal asks for a new trial after his 2024 convictions for the murders of Abby Williams and Libby German. One major issue is whether incriminating statements made while Allen was housed in restrictive conditions at Westville Correctional Facility were voluntary. His lawyer Mark Leeman argued that Allen deteriorated psychologically during prolonged isolation and that his mental collapse cannot be separated from the statements later used against him.The State argued that Allen was housed there to protect him, not to obtain a confession, and that the law requires coercive state action before a statement becomes involuntary on that basis. Judge Nancy Vaidik challenged that framing with six words: “You protected him into psychosis.” The panel also questioned the State about evidence the jury never heard and whether any excluded material could have changed the verdict.Tony Brueski and Bob Motta break down the legal mechanics underneath the headlines: voluntariness, harmless error, the right to present a defense, and the difference between a judge asking a brutal question and a judge announcing a decision. The Court of Appeals took the matter under advisement. Allen remains convicted and sentenced while the panel works toward a written ruling.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Clancy Holdout Juror Fight Just Reached the Judge 03.10.2026 1h 5minThe Lindsay Clancy mistrial left one question hanging over everything: was the jury truly unable to reach a lawful verdict, or should the court have done more before ending the case? This combined episode opens with our before-the-hearing analysis with defense attorney Bob Motta, then shifts into special commentary on what actually happened at the September 29 Rule 25 hearing and the motion to un-impound juror information. Before that hearing, the focus was the lone holdout. Multiple jurors described an 11-to-1 split favoring a verdict of not guilty by reason of lack of criminal responsibility. Foreperson Roni Carlson said the holdout acknowledged reasonable doubt but refused to join the verdict. Juror Nick Dargie said he repeatedly asked the man to identify evidence supporting his position and did not get an answer. The defense argues that sequence matters to whether Judge William Sullivan had a sufficient basis to declare a mistrial. On September 29, Kevin Reddington pushed a different route: Rule 25. He asked Sullivan to find Clancy not guilty because, in his view, the Commonwealth had not presented legally sufficient proof. Prosecutor Shanan Buckingham rejected that characterization and pointed to the evidence and stipulations already put before the jury.Martin Weinberg then argued over sealed jury notes and sidebar transcripts. The defense wants access because those records may become part of its double-jeopardy challenge and its claim that the holdout should have been examined more closely. Prosecutors say opening jury-room material too freely could damage the confidentiality that deliberations depend on.Sullivan did not grant an acquittal, dismiss the case, or order an immediate retrial on September 29. He continued the litigation to November 2. Bob Motta walks through what each motion can actually accomplish, what it cannot, and why the jury-room controversy is now a legal-record fight instead of just a post-trial argument.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Kohberger Pleaded Guilty Six Days After WHAT?! 03.10.2026 29minBryan Kohberger pleaded guilty six days after Judge Steven Hippler denied his defense team more time, and the reason Anne Taylor gave for needing that time is now public. A sealed May 2025 filing said Kohberger was struggling to comprehend adverse rulings and rationally assess what those rulings meant for the direction of his case. The filing did not declare him incompetent. Taylor’s team expressly said it was not making that claim. Instead, the lawyers asked for time to investigate Kohberger’s ability to process consequential decisions and to get expert help communicating with him about how the case might end. Hippler rejected the continuance on June 26, 2025. On July 2, Kohberger stood in court and pleaded guilty to four first-degree murder counts for the deaths of Kaylee Goncalves, Madison Mogen, Xana Kernodle, and Ethan Chapin, plus burglary. He told Hippler he understood the deal and was not being coerced. The agreement removed the death penalty, and Kohberger received four consecutive life sentences without parole plus ten years for burglary. Kohberger’s post-conviction case now asks the court to revisit that record. He alleges ineffective assistance and pressure from his former attorneys. His new counsel is also seeking Hippler’s disqualification, arguing the judge had already been told about the defense team’s concerns before accepting the plea. Eric Faddis joins Tony Brueski for the legal collision at the center of this case: what a defense lawyer warned the judge about before the plea versus what Kohberger personally swore to when the plea was entered. The disqualification motion is set for argument October 15. Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video? Caleb Flynn Told Police “NONE WHATSOEVER” About WHAT?! 03.10.2026 45min“None whatsoever.” That was Caleb Flynn’s answer when Detective Mike Morgan asked about problems in his marriage to Ashley Flynn. By the time jurors heard that interrogation, they had also heard Alleigha Botner read months of messages describing a relationship that looked nothing like the one Flynn presented to police. Botner testified that Flynn promised to leave Ashley again and again. The deadlines moved. He wrote about what he was willing to give up to be with Botner. He paired a demand for proof of love with the sentence “I’m not trying to manipulate you.” Other messages contained repeated hatred toward Ashley, discussion of wanting her dead, and a statement about thinking through ways to kill her and avoid jail. Botner acknowledged her own violent messages too and testified that she meant divorce when she pushed Flynn to make Ashley “gone.” Then came the police interview. Flynn’s phone had no messages from Ashley, and he said he deletes texts to save storage. He offered two strangers as possible suspects. He invoked church. He described a marriage without problems. Robin Dreeke joins Tony Brueski to analyze the sequence — not as a magic lie detector, but as a look at what Flynn chose to explain, deny, and volunteer before investigators laid out everything they knew. At trial, Flynn’s lawyers argued an intruder killed Ashley and that the affair messages were crude fantasy and relationship management, not proof of homicide. Prosecutors argued the messages were part of a much larger evidentiary picture. On September 29, jurors convicted Flynn on all charged counts and firearm specifications. Sentencing is October 5. This episode is about the distance between the relationship Flynn described in that interview room and the one documented in his own texts. From Caleb Flynn's Mistress to Lindsay Clancy's Legal Fight 03.10.2026 56minTwo cases. Three reckonings after court. Caleb Flynn was convicted of aggravated murder — and his mistress Alleigha Botner read his death texts for over a year without saying a word. Could civil court hold her accountable?. In the Lindsay Clancy case, Kevin Reddington spent an entire trial on an insanity defense and now claims there's no evidence Clancy killed her children. And the one juror who held out against acquittal — the man who caused the mistrial — is being investigated at Reddington's request, his identity public, his own lawyer retained. This episode covers the fallout from both cases: the mistress who stayed silent, the attorney who changed the game, and the citizen who voted his conscience and paid for it. Flynn has been convicted. Clancy has pleaded not guilty.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Why the Lindsay Clancy Holdout Juror Needs a Lawyer 02.10.2026 20minOne man on the Lindsay Clancy jury refused to acquit. Eleven others voted not guilty by reason of insanity. When the judge declared a mistrial, defense attorney Kevin Reddington told reporters the vote was for acquittal "minus one." He demanded the court investigate the holdout for misconduct. He identified the juror's gender publicly, narrowing the pool to three men. Media reported his name. His personal history landed in public view. The holdout retained his own attorney and released a statement saying he had no doubt about his position. A hearing on the investigation is scheduled for November 2. This segment asks whether this is advocacy or intimidation — and what message it sends to every woman who gets a jury summons for a high-profile case. Why Lindsay Clancy's Defense Completely Changed Course 02.10.2026 19minDuring Lindsay Clancy's trial, Kevin Reddington never denied she killed Cora, Dawson, and Callan. His defense was postpartum psychosis — she did it, but she wasn't criminally responsible. He offered to stipulate the act in writing. The jury deadlocked 11-1 in favor of acquittal, and the judge declared a mistrial. Then Reddington walked into court and argued there is no evidence Clancy killed her children at all. The Rule 25 motion is a request for the judge to dismiss the case outright. Prosecutors were stunned, calling it the first time they'd heard this argument. The hearing set for November 2 will determine whether the motion has legs — or whether this is a calculated play to build an appellate record before the retrial. Why a Civil Lawsuit Could Reach Caleb Flynn's Mistress 02.10.2026 16minA jury convicted Caleb Flynn of aggravated murder in under three hours. But the guilty verdict raises a question the criminal case never touched. Alleigha Botner, Flynn's 24-year-old mistress, spent eighteen months reading texts where he described hating Ashley and fantasized about her death. She admitted on the stand that she herself once texted about wanting Ashley dead. She lied to the FBI. She stayed in the affair right up until Ashley was shot. Criminal charges against Botner are unlikely, according to legal experts. But civil court operates on a different standard and a different set of tools. Could a wrongful death claim force the mistress into a deposition chair and expose what she knew, what she deleted, and what she did with all of it? Flynn has been convicted. All individuals discussed are presumed innocent of any uncharged conduct until proven guilty.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Caleb Flynn Met Her at Church, Made Her Wait 18 Months, Then Did THIS 02.10.2026 1h 2minHe met her at church. He told her his wife was a roommate. He gave her AI-generated love songs and matching tattoos. He made her wait eighteen months. Then Ashley Flynn was shot twice in the head while their daughters slept down the hall. Psychotherapist Shavaun Scott sits down with Tony Brueski to trace the full arc — from worship leader to murder defendant — across a three-part interview.Part one dissects the foundation. Flynn was 36 and embedded in church leadership at CLC in Miami County, Ohio. Botner was 21 and interning. Scott maps the power imbalance — the age gap, the spiritual authority, the “roommate” narrative — and explains why those details aren’t background. They’re the conditions that made everything that followed possible.Part two follows the holding pattern. For eighteen months, Flynn maintained a double life — his wife Ashley, his children, his reputation, and Botner waiting in the margins. She gave him a deadline in January to leave Ashley. He blew past it. On Valentine’s Day, he returned. Scott explains the intermittent reinforcement and sunk-cost fallacy that made leaving impossible for Botner and unnecessary for Flynn.Part three takes on the 107,000 texts and their escalation to casual discussions of Ashley’s death. Botner testified she texted “I want to kill her.” The public is split on whether she was pushing for murder or divorce. Scott reads both psychologies, then raises the question most people haven’t reached: if Flynn had stayed with Ashley, how much danger was the woman holding his secrets in?Whether you’ve followed every day of the trial or you’re hearing about this relationship for the first time, this three-part interview maps the full arc.Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video? Was Caleb Flynn’s Mistress Pressuring Murder — or Just a Divorce? 01.10.2026 20minThe public is fighting over one question about the Caleb Flynn murder trial: was his mistress pressuring him toward murder, or toward divorce? Psychotherapist Shavaun Scott tells Tony Brueski both readings miss the most dangerous part of this case.In this interview, Scott takes on the 107,000 text messages exchanged between Flynn and Alleigha Botner over eighteen months. The public knows the destination — Ashley Flynn shot twice in the head while sleeping. Scott maps the road. The normalization of violent language in a text thread happens through a process she’s studied: each message escalates only slightly past the previous one, and the gradual shift is invisible from inside the conversation. By the time Botner testified she’d texted “I want to kill her” about Ashley, both she and Flynn had been marinating in that language for months. Scott says the words stopped carrying their literal weight long before anyone died. The complicity debate is real. Botner says she wanted a divorce, not a death. Prosecutors allege Flynn’s actions tell a different story. Scott approaches it through the collision of two psychologies: Botner’s desperation for Flynn to leave his wife, and Flynn’s absolute refusal to sacrifice his image through a divorce. When those two forces met, murder became the option that satisfied both needs — his reputation and her demand that Ashley be gone. Then Scott turns the question: if Flynn had chosen Ashley, how much danger was Botner in? She held every text, every admission, every escalation. She was both the most powerful person in Flynn’s orbit and the most exposed. Scott traces the danger that ran in both directions — and identifies the exact behavioral marker that separates an unstable affair from a lethal situation.Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video? Why Caleb Flynn’s Mistress Kept Believing a Man Who Gave Her Nothing 01.10.2026 23minShe spent holidays alone. He sat at his family’s table, played the devoted husband, then texted her after the kids went to bed. For eighteen months, that was the pattern — and psychotherapist Shavaun Scott tells Tony Brueski it wasn’t just toxic. It was a behavioral trap.Scott maps the psychology of why Alleigha Botner couldn’t walk away from Caleb Flynn despite getting nothing she was promised. The pattern has a clinical name: intermittent reinforcement. Long stretches of empty reassurance punctuated by sudden bursts of attention and reconnection. Scott says it triggers the same reward pathways as gambling — the occasional hit after extended deprivation creates a chemical dependency stronger than consistent love. The January deadline was the clearest proof. Botner told Flynn to leave his wife or it was over. He ignored it entirely. They broke up. On Valentine’s Day he came back, and she let him. Scott says that moment maps perfectly onto the reinforcement cycle: the longer the deprivation, the more powerful the return feels. Botner wasn’t weak. She was locked into a pattern designed to override judgment.Flynn’s psychology is its own problem. Scott profiles a man who believed he was entitled to a wife, children, a church reputation, and a mistress — indefinitely, without consequences. That’s not garden-variety cheating. It’s a specific form of compartmentalization where two contradictory realities coexist because the person refuses to acknowledge either one fully. After eighteen months of investment — emotional, social, psychological — walking away felt like losing everything. The sunk-cost fallacy made staying feel rational. Scott explains what that trap looks like from the inside and what it takes to pull someone out of it from the outside.Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video? A Psychotherapist on What Caleb Flynn Did to a 21-Year-Old Church Intern 01.10.2026 18minShe was 21. He was 36 and married with children. They met at a church where he volunteered on the worship team and she was an intern. Psychotherapist Shavaun Scott joins Tony Brueski to explain why every one of those details matters — and why they mattered before Caleb Flynn ever sent a text message about his wife.Scott starts with the age gap. At 21, Alleigha Botner’s brain was still developing the capacity to evaluate risk and read long-term consequences. Flynn was a decade and a half ahead of her with a marriage, children, and a reputation he’d built at CLC church in Miami County, Ohio. Scott says that differential alone creates a power gap most people outside clinical practice don’t fully appreciate. The church multiplied it. Scott explains how spiritual authority creates what clinicians call a “halo effect” — a shortcut where a man’s connection to worship becomes a proxy for trustworthiness. Red flags don’t land as warnings. They land as signs of a deep bond. When Flynn told Botner his wife was “just a roommate,” that narrative hit a 21-year-old in a church environment differently than it would’ve anywhere else. Scott says it activated a fixing instinct — the pull to rescue instead of run.Flynn gave Botner AI-generated love songs. They got matching hidden Harry Potter tattoos. Scott says those gestures aren’t just immature or theatrical — they’re the construction materials for a fantasy world where two people live inside a shared secret. The secrecy the affair demanded finished the job. Botner couldn’t turn to the friends or family who would’ve seen through it. A psychotherapist can see the design. Scott explains why Botner couldn’t.Listen Anywhere You Get Podcasts: https://pod.link/1655749292 Want to comment and watch this podcast as a video? Richard Allen's 13 Months Alone Was Called This by the State's Own Lawyer 01.10.2026 1h 1minDefense attorney Bob Motta and I sit down with the full Indiana Court of Appeals hearing on Richard Allen's Delphi murders conviction, argued September 21, 2026, and we play the clips that decide it.The center of the appeal is a cell. Allen was moved to Westville Correctional Facility under a safekeeping order in November 2022 and spent thirteen months in a segregation unit before his trial. The confessions the jury heard, 61 by the state's count, all came from that unit in the spring of 2023.Mark Leeman, arguing for Allen, told the judges the state took a pretrial detainee straight to the hole, watched him descend into psychosis, and used what he said there. Deputy Attorney General Ellen Meilaender told the same judges that Allen could not survive general population and that the unit's conditions were ordinary. A replacement tablet, a new window, and visits from his wife, she argued, show he was treated better than other inmates. We also cover the two fights that could matter as much as the confessions. The first is Brad Holder, a man state police investigated in 2017 and never charged. The defense says his hand tattoo and social media posts point to a ritual staging of the scene; the state says he was at work 25 miles away. The second is what's left without any confession at all: an unfired cartridge, an excluded eyewitness sketch, and Allen's own 2017 statement to a conservation officer that he was on the trail.Bob takes each rule apart in plain English: voluntariness and who has to prove it, the direct-connection test for another suspect, and harmless error.Richard Allen is serving 130 years for the murders of Abby Williams and Libby German. Three judges are deciding whether he gets a new trial.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video? Richard Allen's Case Has No DNA, No Witness Who Picked Him, and Exactly This 30.09.2026 14minDefense attorney Bob Motta and I take on the part of Richard Allen's Delphi murders appeal that asks the simplest question: without the confessions, what is there? On September 21, 2026, Richard Allen's appeal lawyer told the Indiana Court of Appeals that no witness ever identified his client as the man in Libby German's video and that no DNA connects him to Abby Williams or Libby. The state did not argue otherwise. What it argued is that Allen's own words to police in 2017, placing himself on the trail and the bridge's first platform, are the most powerful evidence it has. A single unfired cartridge found between the girls, it added, ties him to the scene through his own pistol.Leeman attacked the cartridge match as junk science. William Tobin, the former FBI metallurgist Judge Frances Gull excluded, would have explained why a round found in a field can't be matched the way the state's examiner claimed, he told the panel. The state says the defense's other expert covered that ground and Tobin isn't qualified on firearms.Leeman's rebuttal was about a face. He held up the sketch Betsy Blair helped police draw of the man she saw on the bridge, a sketch the jury was never shown, and argued that Blair saw the killer and did not see Richard Allen. The state told the judges Blair identified the Bridge Guy image at trial, mostly by his clothing, and that a composite sketch is an investigative tool that can't identify or rule out a suspect.Bob explains what the judges meant every time they asked about harmless error, and why the search warrant fight came down to Allen's own 2017 statement. He also takes on what a defense attorney does with a case where the strongest witness against his client is the client.Allen is serving 130 years while the panel decides.Listen Anywhere You Get Podcasts: https://pod.link/1655749292Want to comment and watch this podcast as a video?
